1. Who we are
These terms apply to bookings made with [LEGAL ENTITY NAME], registered in Nepal under company number [NUMBER] (“we”, “us”). We are a booking agency. We charter aircraft from helicopter operators certified by the Civil Aviation Authority of Nepal. We do not own or operate aircraft.
2. What you are buying
A seat, or an aircraft, on a charter flight operated by a certified third-party operator. The operator is responsible for the conduct of the flight, and the pilot in command has final authority over whether, when and how it is flown.
3. Booking and payment
A booking is confirmed when we have issued a written confirmation and received the agreed deposit. The balance is due [TERMS]. Prices are quoted in US dollars and include government taxes on the charter. They exclude the items listed on our price transparency policy page.
4. Weather, delay and cancellation by us
All flights operate under visual flight rules in daylight and are subject to weather, visibility and aircraft availability. Where a flight is held or cancelled for weather, operational or safety reasons, we will offer, at your choice, a rebooking on the next available departure at no additional charge, or a full refund of the charter price.
We are not liable for consequential costs arising from a weather delay, including accommodation, missed onward flights, missed tours or lost trekking days. We strongly recommend building buffer days into any itinerary that depends on a mountain flight, and holding travel insurance that covers delay.

6. Weight, baggage and the right to refuse carriage
Baggage allowances are stated on each route page and are set by aircraft performance at the altitudes flown, not by commercial preference. Passengers and baggage may be weighed before departure. The operator may refuse carriage, reduce the number of passengers on a departure, split a party across multiple flights, or offload baggage where required for safety. Where we cannot carry you for this reason, we will rebook or refund.
The operator may refuse carriage to any person who is intoxicated, who behaves in a way that endangers the aircraft or others, or who declines to follow crew instructions.
7. Health and fitness to fly
High-altitude flights carry health risks including altitude sickness. You must tell us at booking about any heart or lung condition, recent surgery, pregnancy or other relevant condition. You are responsible for taking medical advice about your fitness to fly to high altitude. We may decline a booking on safety grounds.
8. Insurance
Passenger liability insurance is carried by the operator as required by law. It is not travel insurance. You must hold your own travel and medical insurance, including cover for helicopter evacuation at the altitudes you will reach.
9. Medical evacuation
Evacuation flights are arranged in good faith on the information given to us. Where an insurer declines a claim, the person who requested the flight remains responsible for the cost. We will provide the flight manifest and an itemised invoice for every evacuation we arrange.
10. Liability
Our liability is limited to the price paid for the booking. We are not liable for the acts or omissions of the operator, except where we have failed to take reasonable care in selecting them. Nothing in these terms excludes liability for death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.
11. Governing law
These terms are governed by the laws of Nepal, and the courts of [JURISDICTION] have exclusive jurisdiction.
